This happens all the time on the civilian side. Consequently, there was nothing sinister or nefarious in the appellate courts sending the case back for retrial and the command (government) retrying Sgt Hutchins. This did not involve double jeopardy because the case had not been concluded through the appellate level. These were not new proceedings but a continuation of the original proceedings.
